1. Introduction & Scope of Services
Welcome to Fluent With Jason. These Terms of Service apply to your use of the website, learning management system (LMS), and live coaching services provided by Fluent With Jason.
2. Account Rules and Subscriptions
We offer a hybrid learning ecosystem. You may access free materials via the "Free Pass" or subscribe to the "Fluent Pass" for $9.99/month.
Subscriptions: The Fluent Pass is an automatically renewing subscription. It will charge your payment method $9.99 each month until canceled. You maintain complete control over your billing and can cancel anytime directly from your Account Dashboard.
Account Sharing: You may not share your account credentials or allow another person to use your account. We may suspend or terminate accounts when we have reasonable grounds to believe an account is being used by someone other than the registered account holder.
3. Booking Live Sessions
Live sessions are booked individually. Non-members pay the Standard Rate ($35/session), and active Fluent Pass members pay the Member Rate ($25/session). All bookings must be made through our official website calendar.
4. Intellectual Property
Our Content: Unless otherwise stated, the Fluent With Jason website, original courses, lesson materials, videos, written content, graphics, assessments, and other original materials are owned by Fluent With Jason or used under license. Your purchase or subscription grants you a limited, non-exclusive, non-transferable license to access and use these materials strictly for your personal educational study.
Third-Party Materials: We sometimes use licensed educational materials (such as lesson plans from ESL Brains) for specific live sessions. These materials remain the property of their creators and are also for your personal use only.
5. Game 2 Fluency: Trademark Disclaimer
The "Game 2 Fluency" coaching path provides language instruction within third-party video game environments. Fluent With Jason is an independent educational service. We are not affiliated with, associated with, endorsed by, or officially connected to the developers or publishers of any supported games.
All game titles, logos, characters, and other intellectual property referenced on the platform belong to their respective owners. You must independently hold a valid license for any game you wish to play during a live session, and you must adhere to that game's specific rules and terms of service.
6. Educational Results Disclaimer
We provide language coaching and structured curriculum designed to help you improve. However, language learning depends entirely on your personal effort and time invested. We make no guarantees regarding specific outcomes, such as passing standardized tests (e.g., the TOEIC) or achieving a specific fluency level.
7. Termination
We want this to be a safe, supportive space. We may suspend or terminate an account if a user seriously violates these Terms or our Code of Conduct. When an account is terminated, future subscription charges will stop immediately. Any refund will be handled according to our Refund Policy and applicable law.
8. Limitation of Liability
We strive to keep the platform online and running smoothly, but we do not guarantee uninterrupted access. The website and services are provided "as-is". To the maximum extent permitted by law, Fluent With Jason shall not be liable for any indirect or incidental damages resulting from your use of the services. In no event shall our total liability to you exceed the amount you paid for the specific service or subscription in dispute.
9. Governing Law
Fluent With Jason operates out of California. These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States.
Privacy Policy
1. What Data We Collect
To provide you with educational courses and live coaching, we collect basic account information including your name, email address, timezone, and any specific usernames needed for sessions (like your Discord ID). We also keep track of your educational progress in our courses, such as quiz scores and completed lessons.
2. We Do Not Sell Your Data
Fluent With Jason is an education platform, not a data broker. We do not sell, rent, or trade your personal information to third parties. Any information we share with our service providers is strictly to help us run the website and manage your lessons.
3. Payment Information (Stripe)
When you make a purchase, payment information is processed securely by our payment processor, Stripe. We may receive transaction-related information such as your name, email address, billing information, and payment status to manage your account. We do not store full credit or debit card numbers on our servers.
4. Third-Party Services
We use a few standard third-party tools to make the website function properly. Your data may be processed by:
- Hostinger: We use Hostinger to securely host our website and database, and to deliver essential emails (like booking confirmations and password resets).
- Media Platforms: We use BunnyCDN and YouTube to host and deliver video content.
- Analytics: We use basic analytics tools (such as Google Site Kit) with functional cookies to understand general website traffic and keep you securely logged in.
- Live Coaching Platforms: We use Google Meet, VooV, and Discord to conduct live sessions, and Google Calendar to schedule them.
5. Email Communications
We respect your inbox. Fluent With Jason does not currently send promotional marketing newsletters. The only emails you will receive from us are necessary, transactional emails related directly to your account or your booked sessions.
6. Data Storage
Fluent With Jason is based in the United States. Please be aware that your information may be transferred to, stored, and processed in the United States and other countries where our trusted service providers operate.
7. Your Rights
You have the right to know what information we hold about you and to request that we permanently delete your account and personal data. If you wish to manage your data, simply email us directly at support@fluentwithjason.com.
Refund Policy
1. The Fluent Pass (7-Day Guarantee)
We want you to feel completely confident in your decision to join Fluent With Jason.
- The Guarantee: New subscribers may request a full refund within seven (7) days of their initial subscription purchase. Refund requests must be submitted directly to support@fluentwithjason.com. Please note that simply canceling your subscription through your account dashboard stops future billing, but does not automatically issue a refund for the initial payment.
- Recurring Billing: After the initial 7-day period, monthly subscription fees are non-refundable. You can cancel your subscription at any time via your Account Dashboard to prevent future charges.
- Access After Cancellation: If you cancel, you will retain full access to premium courses and discounted live session rates until the end of your current paid billing cycle.
2. Live Session Cancellations and No-Shows
To respect our coaches' time, we require advance notice for schedule changes.
- The 24-Hour Rule: You may cancel or reschedule any live session up to 24 hours before the scheduled start time for a full refund or session credit. Please use the modification link provided in your booking confirmation email.
- Late Cancellations: Cancellations made less than 24 hours in advance, or failure to attend a booked session, are non-refundable. The fee compensates the coach for the reserved time.
- Coach Cancellations: If a coach must cancel a session due to an emergency, you will receive a full refund or a free rescheduled session.
3. Technical Difficulties
We know that technology isn't perfect. Whether a game crashes or a local internet outage occurs, some issues are completely out of your control.
When a genuine technical problem substantially prevents a session from taking place, we may offer a rescheduled session or session credit. Refunds may also be issued when appropriate based on the circumstances. Please reach out to us if you experience a major technical failure so we can help find a fair solution.
(Note: For students in regions with internet restrictions, we highly recommend booking Talk 2 Fluency sessions via VooV Meeting for the most stable connection.)
Code of Conduct
1. Minimum Age Requirements (13+)
To protect the safety of minors and comply with international data privacy laws (such as COPPA), you must be at least 13 years old to use the Fluent With Jason platform. We do not offer coaching, accounts, or services to children under 13.
- Users Ages 13–17: You are welcome to participate in our courses and live sessions, including Game 2 Fluency via Discord. However, you must have explicit permission from a parent or legal guardian to create an account, book sessions, or make purchases using a credit card.
- Account Suspension: If we discover that a user is under the age of 13, their account and any active subscriptions will be immediately terminated in accordance with the law.
2. The "Low-Anxiety" Rule: Anti-Toxicity & Harassment
Our entire teaching philosophy is designed to eliminate the fear of making mistakes. We cannot achieve that if our environment is toxic.
We maintain a strict zero-tolerance policy against:
- Hate Speech & Discrimination: Any slurs, derogatory language, or attacks based on race, ethnicity, nationality, gender, sexual orientation, or religion.
- Harassment & Bullying: Targeting other students or coaches, "creeping," sending unsolicited inappropriate messages, or making others feel uncomfortable.
- Gaming Toxicity: During Game 2 Fluency sessions, you are expected to be a good teammate. Screaming, raging at teammates (in-game or in our Discord), or intentionally throwing matches will not be tolerated. Remember, we are here to learn English, not to go pro.
3. Live Coaching Boundaries
To maintain a professional and comfortable environment during our 1-on-1 sessions on Google Meet, VooV, or Discord:
- Appropriate Settings: Please attend video sessions fully clothed and in an appropriate environment.
- Respecting Time: Please arrive to your booked sessions on time. If you are going to be late, try to message your coach in advance.
- Conversational Boundaries: While our Drop-In Discussions cover a wide range of real-world topics, coaches reserve the right to end a conversation or redirect the topic if it becomes inappropriately sexual, highly aggressive, or makes them uncomfortable.
4. Enforcement and Reporting
We want this to be the safest place on the internet to practice your English. If you ever feel uncomfortable due to the behavior of another student (or a coach), please reach out directly to support@fluentwithjason.com.
If a student violates this Code of Conduct, we will take action to protect our community. Depending on the severity of the violation, this may result in a warning, a temporary ban from live sessions, or permanent termination of the user's account and subscription.
